1. Reservation

Any reservation made in writing, by telephone, via internet or direct to HMJ France becomes officially confirmed as soon as the 1st deposit has been paid by the client.

At the same time, the client must sign the present contract for acceptance of the rental conditions. 

 

2. Payment

When the reservation has been made to HMJ France, the client shall pay a 1st deposit of 20% of the total rent, subject to a minimum of 300€. Should the amount not be paid 8 days after the reservation has been made, the reservation will be cancelled.

The balance shall be paid at the latest 8 weeks prior to the beginning of the rental period. Should the amount not be paid in due time, HMJ France is entitled to cancel the reservation and to retain the 1st deposit.

For reservations made later than 8 weeks prior to the rental period, the total rent is due on booking. 

The payments can be made by cheque, by bank transfer or by credit card on the website of HMJ France (secured transactions).

 

3. Arrival and departure

The client will normally have access to the property between 2 p.m. and 6 p.m. on the stipulated day of arrival.

However, if the client wish to arrive at a different time, for valid reasons, he must inform HMJ France before hand by letter, telephone or fax, and if it is possible, a different arrangement may be organized. 

The rented accommodation shall normally be vacated by 10 a.m. on the stipulated day of departure. In some particular cases and only with HMJ France's agreement, the client may leave at  a different time.

 

4. Number of persons

The rented accommodation must not be occupied by a number of persons larger than its capacity according to HMJ France's description.

Only babies and children under three years old sleeping in a travelling cot will be accepted as an extra person. 

Contravention of this rule gives HMJ France the right to deny the client entrance to the property; in such cases the client has no claim to a refund of the rental amount. 

 

 

5. Security deposit

A security deposit of 30% of the rental amount (with a minimum of 300€) will be paid by the tenant to HMJ France, at the latest 7 days prior to the beginning of the rental. This amount will be held by HMJ France and shall be returned to the client after deductions to cover any damage caused to the accommodation and any applicable extra charges (telephone consumption etc.). The deposit shall be returned within 7 days after client's departure from the property. 

Generally, the client must treat the accommodation and its equipment in an appropriate manner and must leave the accommodation in a clean and undamaged state.

Should the client cause or discover any damage to the accommodation, he shall immediately inform HMJ France.

The client is liable for any damage caused to the accommodation by him or any member of his party during his occupancy.

 

Warning! As third party insurance does not usually cover damage caused to rented accommodation abroad, the client is strongly advised to take out a separate policy before the beginning of the rental.

 

 

6. Re-letting, second thoughts and cancellation

The agreement becomes valid when the 1st deposit has been paid. If the client cancels the reservation at any time, the 1st deposit will be lost.

Cancellation or modification of the reservation between 6 and 8 weeks prior to beginning of the rental will oblige the client to pay 50% of the total price.

Cancellation or modification of the reservation less than 6 weeks prior to beginning of the rental will oblige the client to pay the total price.

Any cancellation shall be made in written form by letter, fax or e-mail, quoting the booking no., client's name and rental period. 

 

Should HMJ France succeed in re-letting the property, the rental paid by the original client will be refunded after deduction of 300€ per rented week and a deduction corresponding to a possible discount offered to the new client.

The accommodation may be re-let by the client to a third party at the latest 5 weeks prior to the beginning of the rental, on condition that the new tenant fulfils the requirements imposed by the accommodation. All costs involved in such re-letting - with a minimum of 50€ - will be charged to the original client.

Certain property owners do not permit re-letting to a third party. 

 

7. Complaints

In the event of complaints about the accommodation or its cleanliness, the following procedures must be followed:

a) The complaint must be reported to HMJ France within 24 hours after taking possession of the accommodation - or immediately upon causing damage or discovering a deficiency.

b) At the latest 14 days after termination of the rental period, the complaint must be reported in writing to HMJ France, with obligation to supply the name of the HMJ France employee who has treated the complaint during the rental (if the complaint is notified by fax, the client must keep the transmission receipt).

c) Should the client leave the accommodation without notifying any complaint to HMJ France or without giving HMJ France reasonable time to attempt to rectify the deficiency, or should points a) and b) be disregarded, the right to complain will be lost unconditionally. The tenant will thus have no claim to a refund, nor will HMJ France be liable to compensate any deficiency or inconvenience in connection with the rental.

 

As not all accommodations in the same building necessarily have the same equipment or fittings, a complaint cannot be based upon differences in equipment compared to accommodations occupied by other clients. Inconveniences caused by circumstances beyond HMJ France's control (e.g. noise nuisances from building or construction sites unknown to HMJ France at the time of reservation), occurrence of ants, mosquitoes or other insects, absence of water in swimming pools, power or water cuts) can not be the subjects of a complaint.

 

8. Price alterations

The prices are updated every year on 1st January. However, HMJ France is entitled to alter its prices proportionately in case of the introduction of new taxes and/or dues or in connection with changes in exchange rates. Price alterations based on the above mentioned factors may not, however, exceed 10% of the rental amount.

 

9. Errors and force majeure

In the occurrence of breach of contract by the accommodation's owner towards HMJ France, or of handling errors, war, strike or force majeure, HMJ France is entitled to cancel the client's reservation and solely refund the amount paid by the client, or to replace the reserved accommodation by another one.

Should the latter have a lower price than the one originally reserved, the difference will be refunded to the client.

 

 

10. Information furnished by HMJ France

All information furnished by HMJ France is based partly on our own inspection of the accommodations and the local facilities, and partly on information gathered from the owners of the accommodations.

Whilst all such information is given in good faith, HMJ France cannot be held responsible for printing errors or inaccuracies concerning distances to certain facilities (beaches, town centre, restaurants, shops, fishing possibilities, sports facilities etc.) nor for the existence of such facilities after the client's reservation has been made.

HMJ France also declines responsibility for possible closure of facilities such as shops, swimming pools, beaches, stretches of road and like conditions beyond HMJ France's control, including e.g. increases in local tourist taxes etc.

 

 

11. Liability

HMJ France's liability is limited to direct economic loss. HMJ France cannot be held responsible for consequential loss or damage, nor for loss or damage of a non-economic nature.

HMJ France's liability is, in all cases, limited to the amount paid by the client.

 

 

12. Special wishes

Special wishes put forward by the client with regard to the accommodation's placing (e.g. on top floor, next to another family, with terrace or balcony) are complied within the bounds of possibility. However, in no circumstances can HMJ France guarantee the satisfaction of such special wishes, nor can HMJ France be held responsible for their non-fulfilment.

 

13. Tenants obligations

It is compulsory for the tenant to:

- Maintain and leave the rented accommodation in a good and clean overall condition, with no damage of any kind at the end of his stay.

- Inform HMJ France immediately if any damage, breakage or loss happens during the rented period, even if there seems to be no visible damage.

- Not make any change to the furniture and equipment, nor modify the position of the furniture.

- Not do anything which may cause trouble to the tranquillity of the neighbours, by himself or any member of his party.

- Respect the interior rules in case of a rental in a shared building.

- Let any urgent work or repair be made in the rented property, if obviously it cannot be postponed.

- Commit himself to use HMJ France if he wishes to rent this property again in the future and not to contact the owner directly to rent the property, by his own means nor through another person.

- Sign the present contract with which he acknowledge that he has read and understood all the rental conditions for himself and as the representative of all the persons who will be renting the property with him.

 

 

14. HMJ France obligations

On its side, HMJ France commits itself to:

- Deliver the rented accommodation in a good and clean overall condition and the equipment in a correct working condition.

- Guarantee the tenant the peaceful use of the rented accommodation and prevent him from any defect which may cause him trouble.

- Except in case of obvious emergency, not make any work in the property during the rented period. Any trouble caused to the tranquillity of the tenant during his rental will lead to a compensation for the tenant.
